Rental Terms & Conditions

These Terms and Conditions govern your use of Loop the Wardrobe’s services and the rental of items from Loop the Wardrobe (“Loop”, “we”, “us”, “our”). By placing a booking or using our services, you (“you” or “your”) agree to these Terms.

Loop currently provides rental services within the Province of Ontario. We reserve the right to expand, restrict, or modify our service areas at any time.

PART I – RENTAL TERMS

1. Rental Period

1.1 A one-time rental allows you to use the rented item(s) for the agreed rental period shown at checkout (the “Rental Period”).

1.2 The Rental Period begins on the start date selected at checkout and specified in your booking confirmation, regardless of actual delivery time. We will make reasonable efforts to ensure the item arrives on or before the Rental Period start date.

1.3 The Rental Period ends on the final date specified in your booking confirmation.

1.4 Items must be returned and scanned by the designated carrier within the Rental Period.

1.5 An item is considered returned only when it has been scanned and accepted by the designated carrier.

2. Use and Care of Items

2.1 You must take reasonable care of all rented items and use them only for their intended purpose.

2.2 Items must not be altered, tailored, repaired, washed, or dry-cleaned by you.

2.3 Normal signs of wear consistent with careful use are acceptable. Damage beyond normal wear (including significant stains, tears, burns, missing components, alterations, or persistent odours) may result in additional charges up to the cost of repair or replacement.

2.4 If you purchase Loop’s optional “Wear and Tear” protection at checkout, it covers minor, accidental damage consistent with typical event wear, including small stains, loose seams, minor fabric pulls, or minor zipper issues. It does not cover significant damage, permanent staining, burns, theft, loss, or failure to return the item.

3. Returns

3.1 All items must be returned and scanned by the designated carrier within the Rental Period using the return method specified by us.

3.2 You are responsible for ensuring the item is scanned and accepted by the carrier within the Rental Period.

3.3 Delays occurring after the item has been properly scanned and accepted by the carrier will not result in late fees.

3.4 Items must be returned in the condition they were received, subject to fair wear and tear.

4. Late Returns and Late Fees

4.1 If an item is not returned and scanned by the designated carrier within the Rental Period, it is considered a Late Return.

4.2 Late fees are charged at $30 per day, per item, beginning the calendar day after the Rental Period ends.

4.3 Late fees accrue for a maximum of seven (7) calendar days.

4.4 If an item has not been returned and scanned by the designated carrier within seven (7) calendar days after the Rental Period ends, it will be deemed a Non-Return and Section 5 will apply.

4.5 You authorise Loop to charge applicable late fees to your nominated payment method.

4.6 Late fees may not be paid using store credit unless we agree otherwise.

5. Non-Return and Replacement

5.1 An item is considered a Non-Return if it has not been returned and scanned by the designated carrier within seven (7) calendar days after the Rental Period ends.

5.2 In the case of a Non-Return, you authorise Loop to charge up to 120% of the item’s recommended retail value (the “Replacement Fee”), less any late fees already paid.

5.3 The Replacement Fee reflects the cost of replacing inventory, administrative handling, and loss of rental availability.

5.4 Upon payment of the Replacement Fee, ownership of the item transfers to you.

5.5 If the item is returned after a Replacement Fee has been charged, Loop may, at its discretion, refund the Replacement Fee less applicable late fees, cleaning costs, damage charges, and reasonable administrative costs.

6. Shipping and Delivery

6.1 We will dispatch your item in advance of the Rental Period using the shipping method selected at checkout.

6.2 Loop may use third-party shipping carriers, courier services, or postal providers at its discretion and may change or substitute its designated carrier or return method at any time.

6.3 “Designated carrier” or “return method specified by us” means the provider and process communicated to you at the time of dispatch.

6.4 Delivery timeframes are estimates only and are not guaranteed.

6.5 Loop is not responsible for delays caused by carriers, weather events, labour disruptions, or circumstances beyond our reasonable control.

6.6 Carrier delays do not extend the Rental Period and do not automatically entitle you to a refund or credit, except as required by law.

6.7 Choosing Your Shipping Method

You are responsible for selecting a shipping method that reasonably aligns with your Rental Period start date.

Next-Day Courier is available only within the City of Toronto and select GTA postal codes. All other deliveries are fulfilled via Canada Post expedited service, which typically requires multiple business days.

If you select a shipping method whose estimated delivery timeframe does not reasonably allow arrival before the Rental Period begins, Loop is not responsible for late arrival.

For Canada Post deliveries, we recommend placing your order at least three (3) to four (4) business days prior to your Rental Period start date so we have time to prepare your order and ship out. Canada Post Xpresspost, which typically delivers within Ontario in approximately one (1) to two (2) business days between major urban centres, though delivery timeframes are estimates only and not guaranteed.

6.8 Time-Sensitive Bookings

If your Rental Period begins within one (1) business day of placing your booking, Next-Day Courier (where available) is the only shipping option intended for that timeframe.

Bookings placed less than three (3) business days before the Rental Period start date using Canada Post are considered time-sensitive bookings. Carrier-related delays for such bookings do not entitle you to a refund or credit.

7. Cancellations

7.1 You may cancel a booking provided the item has not yet been prepared for shipment.

7.2 Cancellation cut-offs:

(a) Toronto courier delivery: up to 24 hours before the Rental Period begins.

(b) Canada Post expedited shipping: at least three (3) calendar days before the Rental Period begins.

7.3 Once an item has been prepared for shipment or dispatched, the booking cannot be cancelled.

8. Refunds

8.1 You must notify us within 24 hours of delivery if there is an issue with your order.

8.2 Items requested for return review must be returned within 24 hours, unworn, with tags and packaging intact.

8.3 Refund eligibility is subject to inspection.

8.4 Approved refunds will be issued to the original payment method, less shipping costs where permitted by law.

8.5 Nothing in these Terms limits your rights under Ontario consumer protection law.

9. Payment Authorisation

By placing a booking, you authorise Loop to charge your nominated payment method for rental fees, late fees, Replacement Fees, damage charges, and any other amounts payable under these Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

PART II – GENERAL TERMS

11. Website Use and Accounts

You agree to use this website lawfully. You are responsible for your account activity. We may refuse service or cancel orders where we reasonably believe there has been fraudulent, abusive, or unlawful conduct.

12. Limitation of Liability

To the fullest extent permitted by law, Loop is not liable for indirect, incidental, special, consequential, or punitive damages.

Loop’s total liability for any claim relating to your booking or use of our services will not exceed the amount paid for the applicable rental.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Assumption of Risk and Indemnity

Rented garments are pre-worn and may contain minor imperfections consistent with rental use.

You assume responsibility for your use of rented items and agree to indemnify Loop from claims arising from misuse or breach of these Terms.

14. Force Majeure

Loop is not liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, severe weather, labour disruptions, or governmental actions.

15. Intellectual Property

All website content, branding, imagery, and materials are the property of Loop the Wardrobe or its licensors and may not be used without permission.

16. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Loop the Wardrobe.
